1. Acceptance of Terms

By accessing or using the PhishIQ platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree, you may not use our Services.

2. Description of Services

PhishIQ provides an AI-powered phishing simulation and security awareness training platform that enables organizations to:

• Conduct simulated phishing campaigns to assess employee security awareness
• Deliver interactive security training modules
• Generate compliance and risk assessment reports
• Integrate with email systems (Microsoft 365, Google Workspace) for campaign delivery
• Access AI-generated phishing templates and threat intelligence

3. Account Registration

To use the Services, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use at support@phishiq.io.

4. Authorized Use

You agree to use PhishIQ only for legitimate security awareness purposes. Specifically, you must:

• Only send simulated phishing campaigns to users within your own organization or with explicit written consent
• Ensure campaigns comply with your organization's internal policies and applicable laws
• Not use the platform to conduct real phishing attacks, harvest real credentials, or engage in social engineering against unauthorized targets
• Not use the platform to send spam, malware, or any harmful content
• Not reverse-engineer, decompile, or disassemble any part of the Services
• Not attempt to gain unauthorized access to other accounts or systems

Violation of these terms may result in immediate account suspension or termination without refund.

5. Subscription and Payment

5.1 Plans

PhishIQ offers tiered subscription plans (Starter, Professional, Enterprise) with varying features and user limits. Plan details and pricing are available on our website and may be updated from time to time.

5.2 Billing

Subscriptions are billed annually or monthly as selected during purchase. Payments are non-refundable except as required by law or as otherwise stated in these Terms. We reserve the right to change pricing with 30 days' prior notice before the next billing cycle.

5.3 Free Trials

We may offer free trials at our discretion. At the end of a trial, your account will be converted to a paid subscription or downgraded unless you cancel before the trial period ends.

6. Intellectual Property

All content, features, and functionality of the PhishIQ platform — including but not limited to software, text, graphics, logos, templates, AI-generated content, and training materials — are owned by PhishIQ and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your organizational data. By using the Services, you grant PhishIQ a limited license to process your data solely to provide the Services.

7. Data and Privacy

Our collection and use of personal information is governed by our Privacy Policy. By using the Services, you acknowledge and agree to the practices described therein.

You are responsible for ensuring that your use of the Services complies with applicable data protection regulations (including GDPR, CCPA, and other local laws) and that you have obtained all necessary consents from your end users before enrolling them in phishing simulations.

8. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors outside our reasonable control, including internet outages, third-party service failures, or force majeure events.

9. Limitation of Liability

To the maximum extent permitted by law, PhishIQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Services.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to PhishIQ in the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless PhishIQ, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

Either party may terminate the subscription with 30 days' written notice. We may suspend or terminate your access immediately if you violate these Terms, particularly the Authorized Use provisions. Upon termination, you may request an export of your data within 30 days, after which it will be deleted in accordance with our data retention policy.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the platform at least 30 days before taking effect. Continued use of the Services after changes constitute acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Delaware.
